Terms of Service

1. Acceptance of Terms

By accessing or using the Hoard platform, website, and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.

These Terms apply to all users of the Services, including individual agents, brokerage administrators, and team members.

2. Description of Services

Hoard provides a real estate deal operating system that includes contact management, pipeline tracking, listing management, buyer matching, team collaboration tools, and AI-assisted workflow guidance. The specific features available to you depend on your subscription plan.

3. Account Registration and Security

You must provide accurate and complete information when registering for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@use-hoard.com if you suspect unauthorized access.

4. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Upload or transmit malware, viruses, or harmful code
  • Attempt to gain unauthorized access to any part of the Services
  • Resell, sublicense, or otherwise commercialize the Services without our written permission
  • Use the Services to send unsolicited bulk communications
  • Collect or scrape data from the Services using automated means

5. SMS Messaging Terms

By providing your mobile phone number and opting in to SMS communications through the Services, you consent to receive automated text messages from Hoard and, where applicable, from features you configure within the platform.

  • Message and data rates may apply based on your mobile carrier plan.
  • Message frequency varies based on account activity.
  • Reply STOP to any SMS message to opt out of all future text messages from Hoard. You will receive a one-time confirmation that your opt-out has been processed. After opting out, you will not receive additional messages unless you re-opt-in.
  • Reply HELP to any SMS message to receive help and support information, contact us at support@use-hoard.com, or call 702-355-7823.
  • Opting out of SMS will not affect your access to the Services.

6. Subscription and Payment

Certain features of the Services require a paid subscription. Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your plan). You authorize us to charge the payment method on file.

We reserve the right to modify pricing with reasonable notice. Continued use of the Services after a price change constitutes your acceptance of the new pricing.

7. Intellectual Property

All intellectual property rights in the Services, including software, design, content, and trademarks, are owned by or licensed to Hoard. You are granted a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.

You retain ownership of any data you upload to the Services. By uploading data, you grant us a license to use it solely to provide and improve the Services.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOARD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO HOARD IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Termination

We reserve the right to suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason at our sole discretion. You may terminate your account at any time by contacting support@use-hoard.com.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to conflict of law principles.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with an updated effective date. Continued use of the Services following any changes constitutes acceptance of the new Terms.
